These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you") and NuClear Detailing (Pty) Ltd ("NuClear Detailing", "we", "us", "our") governing your use of our website and detailing services. By booking our services, you agree to be bound by these Terms in accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Consumer Protection Act 68 of 2008 (CPA) of South Africa.
1. Services Offered
NuClear Detailing (Pty) Ltd provides professional mobile car detailing services including, but not limited to:
- Interior cleaning and restoration
- Exterior washing, decontamination and protection
- Paint correction and enhancement polishing
- Ceramic and graphene coating application
- Engine bay cleaning
- Custom detailing solutions
Service descriptions on our website are for informational purposes. Final scope of work will be confirmed prior to service commencement based on vehicle inspection.
2. Bookings and Appointments
- All services are provided by appointment only
- Bookings are confirmed once acknowledged via email, WhatsApp, or phone
- You must ensure the vehicle is accessible at the agreed time and location
- We reserve the right to refuse service if the vehicle condition poses health or safety risks
- Appointment times are estimates; actual duration may vary based on vehicle condition
3. Pricing and Payment
- Prices listed are estimates based on standard vehicle conditions
- Final pricing will be confirmed after vehicle inspection and before work begins
- Additional charges may apply for excessively dirty vehicles, pet hair removal, biohazard cleaning, or heavily neglected interiors
- Payment is due in full upon completion of services unless otherwise agreed in writing
- We accept cash, EFT, and major digital payment methods
- Prices are quoted in South African Rand (ZAR) and include VAT where applicable
4. Cancellation and No-Show Policy
Important: Please read carefully
- 48+ hours notice: Full refund or free rescheduling
- 24-48 hours notice: 50% cancellation fee or rescheduling with R200 fee
- Less than 24 hours notice: 100% of quoted service fee will be charged
- No-show: Full service amount will be charged, and future bookings may require a deposit
We understand emergencies happen. Please contact us as soon as possible if you need to reschedule.
5. Vehicle Inspection and Pre-Existing Conditions
- A visual inspection will be conducted before and after service
- Pre-existing damage, scratches, dents, chips, and paint defects will be noted prior to work
- You are encouraged to point out any areas of concern before service begins
- We may take photographs to document the vehicle's condition before and after service
- By proceeding with service, you acknowledge the documented pre-existing conditions
6. Limitation of Liability
While we exercise the utmost care and use professional-grade products and techniques, NuClear Detailing (Pty) Ltd shall not be held liable for:
- Pre-existing damage, defects, or wear not caused by our services
- Paint damage resulting from poor previous paintwork, rust, or factory defects
- Damage to aftermarket accessories, modifications, or non-OEM parts
- Fading, peeling, or lifting of vinyl wraps, decals, or tinted windows
- Damage caused by concealed defects that become visible after cleaning
- Personal items, valuables, or cash left in the vehicle
- Mechanical or electrical faults unrelated to our services
- Any damage exceeding the value of the service rendered
Our maximum liability for any claim shall not exceed the total amount paid for the specific service in question.
7. Paint Correction Disclaimer
Special Notice for Paint Correction Services
- Paint correction results depend entirely on the existing condition of your vehicle's paintwork
- 100% defect removal is not always possible and is never guaranteed
- Deep scratches, stone chips, and oxidation damage may not be fully removable
- We will provide an honest assessment of expected results before proceeding
- By authorising paint correction, you accept that results may vary
8. Ceramic Coating Terms
- Ceramic and graphene coatings are sold without warranty
- Coating longevity depends on proper maintenance and aftercare as advised
- Coating performance depends on proper curing time - vehicle must remain dry for 24-48 hours post-application
- We are not liable for coating failure due to improper aftercare or use of incompatible products
- Results may vary based on paint condition and environmental factors
9. Photographs and Marketing
By using our services, you grant NuClear Detailing (Pty) Ltd permission to:
- Photograph your vehicle before and after service for quality documentation
- Use these photographs for marketing, social media, and promotional purposes
- No personally identifiable information (registration plates, personal items) will be shared without consent
If you do not wish your vehicle to be photographed for marketing, please inform us before service begins.
10. Consumer Rights (CPA Compliance)
In accordance with the Consumer Protection Act 68 of 2008, you have the right to:
- Receive services that are of good quality and performed with reasonable care and skill
- Receive accurate and honest information about our services and pricing
- Fair, just, and reasonable contract terms
- Lodge complaints and have them addressed within a reasonable timeframe
- A refund or redo of services if they are not rendered as agreed (subject to investigation)
11. Complaints and Dispute Resolution
- Any concerns must be raised within 24 hours of service completion
- Claims must be accompanied by photographic evidence
- We will investigate all complaints fairly and respond within 7 business days
- If we are at fault, we will offer a reasonable remedy (re-service or partial refund)
- Disputes not resolved amicably may be referred to the National Consumer Commission or appropriate small claims court
12. Intellectual Property
All content on this website, including but not limited to logos, text, images, graphics, and design elements, is the exclusive property of NuClear Detailing (Pty) Ltd and is protected by South African intellectual property laws. Unauthorised reproduction, distribution, or use is strictly prohibited.
13. Indemnification
You agree to indemnify and hold harmless NuClear Detailing (Pty) Ltd, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms, misrepresentation of vehicle condition, or failure to disclose relevant information about your vehicle.
14. Force Majeure
NuClear Detailing shall not be liable for any delay or failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, power outages, civil unrest, or government restrictions.
15. Amendments
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the South African courts.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
